Terms & Conditions
These General Terms and Conditions ("Terms") govern all purchases made through this online shop operated by [Company Name] ("we", "us", "Seller"). By placing an order, the customer accepts these Terms.
1. Scope
These Terms apply to all contracts concluded between the Seller and consumers or business customers through this website. Deviating terms of the customer do not apply unless expressly agreed in writing.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a binding offer. By placing an order the customer makes a binding offer to purchase. The contract is concluded when we accept the order through an order confirmation sent by email or by dispatching the goods.
3. Prices and Payment
All prices are shown in euros and include the applicable statutory value added tax (VAT). Shipping costs are displayed before the order is finalised. Payment is accepted via the methods offered at checkout (e.g. credit card, debit card, instant bank transfer, PayPal, Klarna). Payment is due upon conclusion of the contract unless another due date is agreed.
4. Delivery
Goods are delivered to the shipping address provided by the customer. Estimated delivery times are communicated at checkout and on the Shipping & Returns page. The risk of accidental loss passes to consumers only upon handover of the goods.
5. Retention of Title
The delivered goods remain the property of the Seller until full payment has been received.
6. Right of Withdrawal
Consumers have a statutory right of withdrawal of 14 days. Details, exceptions and the model withdrawal form are available on our Right of Withdrawal page.
7. Statutory Warranty
Statutory warranty rights under EU and national consumer law apply. In case of a defect, the customer is entitled to repair or replacement and, where applicable, to a price reduction or rescission of the contract. The warranty period is two years from delivery for consumers.
8. Liability
We are liable without limitation for intent and gross negligence as well as for damages arising from injury to life, body or health. In cases of slight negligence, liability is limited to the breach of essential contractual obligations and to foreseeable, contract-typical damages. Mandatory statutory liability, in particular under the Product Liability Act, remains unaffected.
9. Applicable Law and Jurisdiction
These Terms and all contracts concluded under them are governed by the laws of [Country], excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.
10. Online Dispute Resolution
The European Commission operates an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Severability
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
